On February 23, 2007, the Supreme Court of Canada released the Charkaoui decision, ruling that the security certificate process was unconstitutional. The full decision can be downloaded here.

What is Federal Court Watch?

Federal Court Watch is an initiative in the campaign against security certificates. Modelled on Cop Watch projects, Federal Court Watch aims to mobilize public scrutiny and networks to protect community members against abusive power.

WHY FEDERAL COURT WATCH

Since the new security certificate law, Bill C-3, entered into force, there has been growing concern about the role the Federal Court is playing in security certificate cases. Those closely observing the cases are concerned that the Federal Court has failed to come to terms with the fact that it has been applying an unconstitutional (thus illegal) law for years. The principles on which the Supreme Court made its unanimous decision to strike down the security certificate law in February 2007 are not evident in the Federal Court's current handling of these cases.
