Legal motion to lift conditions imposed on Charkaoui

The following is a motion argued by Me. Dominique Larochelle on behalf of Adil Charkaoui in Federal Court on 22 August 2007. The motion seeks to have the conditions imposed on Mr. Charkaoui lifted in light of the Supreme Court ruling that security certificates are unconstitutional and in light of information that has shown the allegations against Mr. Charkaoui to be unfounded.

Montreal, 22 August 2007 - Mr. Charkaoui's Federal Court hearings are set to continue tomorrow, Thursday, 23 August, from 9:30 am at 30 McGill St, Montreal. Me. Johanne Doyon will present arguments relating to the criminal leak of secret information in Mr. Charkaoui's file, with a view towards ending the security certificate proceedings against Mr. Charkaoui. The major part of the day is likely to be devoted to hearing further arguments presented by Me. Dominique Larochelle to support Mr. Charkaoui's bid to lift the conditions imposed on him since 2005.

In June, the Montreal daily La Presse published leaked top secret information, containing unproven, sensational allegations against Adil Charkaoui. Charkaoui will be in court this week to argue that the criminal leak of information constitutes a violation of his charter rights and an abuse of procedure. He will argue that the security certificate proceedings against him should be halted on this basis.

In a separate motion, he will argue that the conditions imposed on him should be lifted in view of the February 2007 Supreme Court ruling that the security certificate process is unconstitutional and in light of several revelations about the lack of credibility of the secret information in his file.

RCMP to investigate Charkaoui document leak

MONTREAL -- Public Safety Minister Stockwell Day indicated he has confidence in any RCMP investigation into the leak of information about a man suspected of terrorism.

"When the RCMP says they are investigating a file then that is exactly what they would be doing and we'll await the results of that investigation," Day said Wednesday, declining to be more specific. The RCMP would not immediately comment on the news an investigation has begun into the leak of classified documents on Adil Charkaoui to a Montreal newspaper.

Recent published reports citing CSIS documents claimed Charkaoui was involved in a plot to fly a plane into a foreign target, something he has denied.

The Coalition Justice for Adil Charkaoui held a press conference this morning to respond to the leak of a secret document, apparently part of Mr. Charkaoui's security certificate file, to the Montreal daily newspaper La Presse.

At the Press Conference, Mr. Charkaoui categorically denied the allegations which La Presse reported were contained in the secret document and the Coalition called for 1) a police inquiry into the criminal leak of the secret document; 2) a public inquiry into the actions of the Canadian Security Intelligence Service (CSIS) in Mr. Charkaoui's case; and 3) the retraction of the security certificate issued against Mr. Charkaoui.
